Welcome to Marvely ("the Application"), a language learning application hosted by Zzish Limited ("the Company") in the United Kingdom. By accessing or using the Application, you agree to comply with and be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Application.

2. Use of the Application

2.1 Eligibility

To use the Application, you must be at least 13 years old. By using the Application, you represent and warrant that you are at least 13 years old.

  • Harass, threaten, or harm other users or the avatars.
  • Engage in any activity that interferes with or disrupts the Application.

3. AI-Powered Avatars

3.1 Nature of Conversations

The Application features AI-powered avatars that engage in spoken conversations with users in immersive scenarios. These avatars may represent real people, including celebrities, content creators, and teachers. All phrases and speech generated by the avatars are created by artificial intelligence and do not constitute real conversations.

3.2 Representation of Avatars

All content generated by the avatars, including advice, recommendations, suggestions, and comments, is for entertainment and educational purposes only and should not be taken as genuine advice, recommendations, suggestions, or comments. It is important to remember that these conversations are simulated and do not represent real-world scenarios.

3.3 Prohibited Conduct

Users are prohibited from saying inappropriate, offensive, or harmful things to the avatars. This includes, but is not limited to, language that is:

  • Sexually explicit or suggestive.
  • Abusive or harassing.
  • Discriminatory or hateful based on race, gender, religion, nationality, disability, sexual orientation, or any other characteristic.

3.4 Disclaimer of Liability

You agree that you will not hold the Company, or any real people behind the avatars, responsible for any actions you take as a result of using the Application. This includes, but is not limited to, any decisions, actions, or consequences arising from the advice, recommendations, suggestions, or comments made by the avatars.

4. Intellectual Property

4.1 Ownership

All intellectual property rights in the Application, including but not limited to text, graphics, logos, and software, are owned by or licensed to the Company. You may not reproduce, distribute, modify, or create derivative works of any part of the Application without the Company's prior written consent.

4.2 AI Created Content

You are allowed to share audio recordings of your conversations and screenshots of the Application on your personal social media accounts to demonstrate usage of the Application.

You are expressly prohibited from using audio speech recordings of any avatars (real or fictional):

  • For any commercial purpose.
  • Outside the context of demonstrating usage of the Application.
  • In any way that deliberately or accidentally presents the audio as the speech of a real person.

4.2 User Content

By submitting content to the Application, you grant the Company a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable licence to use, reproduce, modify, and distribute such content for any purpose.

5. Disclaimers

5.1 No Warranty

The Application is provided "as is" and "as available" without any warranties of any kind, either express or implied. The Company does not warrant that the Application will be uninterrupted or error-free.

5.2 Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Application.

6. Privacy Policy

7. Changes to Terms
